WASHINGTON – The Department of Justice announced today that it has opened an environmental justice investigation into the wastewater disposal and infectious disease and outbreaks programs of the Alabama Department of Public Health and the Lowndes County, Alabama, Health Department.

The investigation, which will be conducted by the Civil Rights Division, will examine whether the Alabama Department of Public Health and the Lowndes County Health Department operate their onsite wastewater disposal program and infectious diseases and outbreaks program in a manner that discriminates against Black residents of Lowndes County in violation of Title VI of the Civil Rights Act of 1964 (Title VI). The investigation will also examine whether the health departments’ policies and practices have caused Black residents of Lowndes County to have diminished access to adequate sanitation systems and to disproportionately and unjustifiably bear the risk of adverse health effects associated with inadequate wastewater treatment, such as hookworm infections.

“Sanitation is a basic human need, and no one in the United States should be exposed to risk of illness and other serious harm because of inadequate access to safe and effective sewage management,” said Assistant Attorney General Kristen Clarke for the Justice Department’s Civil Rights Division. “State and local health officials are obligated, under federal civil rights laws, to protect the health and safety of all their residents. We will conduct a fair and thorough investigation of these environmental justice concerns and their impact on the health, life, and safety of people across Lowndes County, Alabama.”

The department has not reached any conclusions regarding the allegations in this matter. This investigation marks the Department of Justice’s first Title VI environmental justice investigation for one of the department’s funding recipients. Title VI prohibits recipients of federal financial assistance from discriminating on the basis of race, color or national origin. Up until now, the Civil Rights Division has regularly provided counsel and support to other federal agencies whose Title VI compliance efforts have involved environmental programs. The department’s grants do not often go to programs that conduct environmental work, limiting its direct jurisdiction to conduct these types of administrative investigations.

The Civil Rights Division’s Federal Coordination and Compliance Section is conducting this investigation with the support of the U.S. Attorney’s Office for the Middle District of Alabama. Individuals with relevant information are encouraged to contact the Federal Coordination and Compliance Section by email at AL.Lowndes.EJ@usdoj.gov.

(MONTGOMERY) – For the second time this year, the Alabama Supreme Court has ruled that electronic bingo is illegal within the state of Alabama, Attorney General Luther Strange announced Friday.

In the case State of Alabama v. 825 Electronic Gambling Devices et al (Greenetrack), the Alabama Supreme Court ruled in favor of the State, reversing a lower court judgment siding with the casino. As a result, the State of Alabama is allowed to destroy the electronic bingo machines it seized from Greenetrack.

In its 29-page ruling released Friday, the Supreme Court reaffirmed its March 31, 2016 ruling in a similar case involving the legality of electronic bingo machines.

“There is no longer any room for uncertainty, nor justification for continuing dispute, as to the meaning of [the term ‘bingo’]. And certainly the need for any further expenditure of judicial resources, including the resources of this Court, to examine this issue is at an end. All that is left is for the law of this State to be enforced,” the Supreme Court said.

In a separate case (Macon County Greyhound Park, Inc., d/b/a Victoryland v Marie Hoffman), the Supreme Court ruled that individuals have a right to sue illegal gambling institutions.

“Because the ‘contracts’ containing the arbitration provisions in these cases were based on gambling consideration, they were based solely on criminal conduct, and are therefore void. Consequently, the provisions of those ‘contracts,’ including arbitration provisions are void and unenforceable,” the Supreme Court ruled.

Attorney General Strange emphasized that these rulings, combined with the Supreme Court’s March 31, 2016 ruling against Victoryland, remove any doubt that electronic bingo in all its forms is illegal in Alabama and that local law enforcement should do their duty to enforce the law.

“Local sheriffs and police officers in most parts of the State are enforcing our gambling laws. The sheriffs in Greene and Macon counties must uphold their sworn duty to enforce the law as interpreted by the Supreme Court and not continue to sanction this illegal activity. As I have previously stated, my office stands ready to render any required assistance to enable them to carry out their legal duties.”

Attorney General Strange commended Assistant Attorney General John Kachelman of the Criminal Trials Division, as well as agents in his Investigations Division and all law enforcement officers who assisted with the Greenetrack case, including former agents Mike Reese and William Carson for their dedicated work.

FLORENCE-Police have released the name of the deceased in what authorities are calling a home invasion gone bad.

According to Florence police Lt. Robert Richey, officers responded to a “shots fired” call in the 1100 block of East Limestone Street around 3:30am. As officers were responding to the scene they were notified by a homeowner that a home invasion had occurred at his residence resulting in the shots being fired.

Officers located James Devaughn Demoss, 26, of Hanceville, Alabama, who had been shot multiple times by the homeowner inside his residence. Mr. Demoss was provided first aid by responding officers and was transported to ECM hospital where he was pronounced dead.

Officers worked throughout the day Tuesday collecting evidence and speaking with witnesses.

Based on the evidence in this case, police say this is not a random act of violence. Detectives say this particular residence was specifically targeted and DeMoss may not have acted alone.

Police are asking for the community’s assistance in locating potential witnesses in this case. Anyone with information is asked to contact the Florence Police Department at 256-760-6610.

WASHINGTON – A number of tax return preparation businesses in the Birmingham, Alabama area unlawfully understate their customers’ income tax liabilities and overstate refunds by making deliberate misstatements on the returns, according to a new civil lawsuit filed by the Justice Department on Wednesday. The suit, filed in federal court in Birmingham, asks the court to permanently bar Jessica Leverett aka Jessica Harris, from preparing tax returns for others. The suit also asks the court to order Leverett to turn over a list of all of the tax returns she has prepared.

According to the complaint, Leverett owns and operates a number of different tax preparation businesses in the area, including Tax Money Now, L.L.C., Dynamic Tax Services, Dynamic Tax Solutions and Express Money Tax. The government’s complaint alleges that Leverett and her associates prepared returns that fabricate self-employment businesses and business losses to offset their customers’ taxable income from other sources and to increase their customers’ Earned Income Tax Credit. When a customer does have a small business, the complaint alleges, Leverett and her associates mischaracterize the business income as household employee wages in order to avoid paying the required self-employment tax. The complaint also alleges that Leverett’s businesses claim education credits that the customers are not entitled to receive.

According to the complaint, the Internal Revenue Service (IRS) has examined 264 returns prepared by Leverett’s businesses and found that 206 understate the tax owed by Leverett’s customers by thousands of dollars on average. The complaint alleges that Leverett’s activities may have caused the United States to lose over $2.5 million in understated taxes and/or fraudulent refunds.

Return preparer fraud is one of the IRS’s Dirty Dozen Tax Scams for 2016. The IRS has some tips on their website for choosing a tax preparer, and has launched a free directory of federal tax preparers. In the past decade, the Tax Division has obtained injunctions against hundreds of unscrupulous tax preparers. Information about these cases is available on the Justice Department’s website. An alphabetical listing of persons enjoined from preparing returns and promoting tax schemes can be found on this page. If you believe that one of the enjoined persons or businesses may be violating an injunction, please contact the Tax Division with details.

(MONTGOMERY)—On Tuesday, Alabama Attorney General Luther Strange announced that he has issued cease and desist letters to DraftKings and FanDuel after reviewing Alabama’s gambling statutes and determining that paid daily fantasy sports contests constitute illegal gambling. DraftKings and FanDuel have until May 1, 2016, to cease offering paid daily fantasy sports contests in Alabama.

“As Attorney General, it is my duty to uphold Alabama law, including the laws against illegal gambling,” Attorney General Strange said. “Daily fantasy sports operators claim that they operate legally under Alabama law. However, paid daily fantasy sports contests are in fact illegal gambling under Alabama law.”

In Alabama, an activity constitutes illegal gambling if a person stakes something of value on a contest of chance, even when skill is involved, in order to win a prize.

In paid daily fantasy sports contests, players create a “fantasy roster” of real-life athletes. Each athlete is awarded points based on his or her performance, and the “owners” of the teams with the highest scoring rosters win cash prizes.

There is, of course, a measure of skill involved in creating a fantasy roster. But in the end, contestants have no control over the performance of the players on their rosters. For example, a player could fall ill before a game, be injured in pre-game warm-ups, or miss a large portion of the game due to injury or equipment failure. All of these factors, and many more, are outside the control of a fantasy sports player. Thus, the results of paid daily fantasy sports contests depend to a large degree on chance. This is the very definition of gambling under Alabama law.

Alabama now joins 11 other states in which paid daily fantasy sports contests have been declared illegal.

An eight-count indictment filed in U.S. District Court charges BRITTANY NICOLE HARPER, 30, of Joplin, Mo., with one count of conspiracy to transport a stolen vehicle across state lines, two counts of transporting a stolen vehicle across state lines, three counts of carjacking and two counts of brandishing a gun during a crime of violence.
The indictment states that the purpose of the conspiracy was for Harper and “her co-conspirator to unlawfully obtain vehicles, by whatever means necessary,” including acts of violence, and then to use the stolen vehicles as transportation between various states. The indictment refers throughout to Harper’s co-conspirator, but does not name him.

Harper was arrested in Milton, Fla., on Feb. 5, after a face-off with police in which her co-conspirator was shot and killed. She faces state charges in Florida.

“Anyone who chooses to move from state to state, repeatedly and violently taking whatever they want along the way and threatening the lives of innocent people, has to know that the criminal rampage will not last long,” Vance said. “Law enforcement will catch up to them.”

The indictment describes a 10-day, four-state crime spree by Harper and her male companion that began in Webb City, Mo., on Jan. 26, when the couple took a 2009 Cadillac on a test drive from a dealership and never returned. Highlights of the crime spree, as outlined in the indictment, are as follows:

Before arriving in Alabama, the couple burglarized a home in Missouri, where they parked the stolen Cadillac in the garage and stole a 2007 Chevrolet Trailblazer parked at the home.

The couple’s first crime in Alabama is listed as a theft at the Walmart in Bessemer on Jan. 30, before the couple drove the Trailblazer to Tuscaloosa, where they forced a motel clerk at gunpoint into the backseat of the 2011 Volkswagen Jetta he had driven to work. Harper and her companion drove the Jetta to Hoover, where they tried, unsuccessfully, on Jan. 31, to take a Camaro from a McDonald’s employee, and then released the motel clerk in Vestavia Hills.

Soon after releasing the clerk, Harper’s companion entered a home on Monte Vista Drive in Vestavia Hills, where he encountered one of the home owners and his minor children. The co-conspirator put a gun to the man’s neck and began forcing him toward the garage, but the man got free and went for help. The co-conspirator then forced the man’s wife at gunpoint into the homeowners’ 2010 Ford Edge and drove away.
Harper and her companion released the woman near the Grandview Medical Center on Cahaba River Road in Birmingham, and then drove the stolen Ford Edge to Perry County, Ga.

The indictment lists other crimes in Georgia and Florida before Harper’s arrest on Feb. 5 following a high-speed chase through neighborhoods in Milton, Fla., after police confronted the couple.

The other crimes listed as part of the conspiracy, but not individually charged in the indictment, include the robbery and kidnapping of a convenience store clerk in Perry, Ga., on Feb. 1, the robbery of Alvin’s Island beach shop in Destin, Fla., on Feb. 3, and the robbery of a shoe store and a home invasion and carjacking, all in Pensacola, Fla., on Feb. 4.

The FBI investigated the case, which Assistant U.S. Attorneys John B. Felton and Erica W. Barnes are prosecuting.

Caldwell of the Justice Department’s Criminal Division.

GREGORY JEROME LEE, 53, was indicted on four counts of production of child pornography, one count of conspiracy to advertise child pornography and one count of conspiracy to distribute and receive child pornography.

According to the indictment, from September 1996 through December 2004, Lee used, persuaded, coerced and enticed minors to engage in sexually explicit conduct in order to produce images of that conduct. Between September 1996 and August 2007, Lee conspired with other individuals to distribute and receive child pornography through a variety of means, including the Internet.

The U.S. Postal Inspection Service is investigating the case. Assistant U.S. Attorney Jacquelyn Hutzell and Trial Attorney Amy E. Larson of the Criminal Division’s Child Exploitation and Obscenity Section are prosecuting the case.

The charges and allegations contained in an indictment are merely accusations. The defendant is presumed innocent until and unless proven guilty. Members of the public who may have information related to this matter should call the USPIS Birmingham Office at (205) 326-2909.

This case was brought as part of Project Safe Childhood, a nationwide initiative to combat the growing epidemic of child sexual exploitation and abuse launched in May 2006 by the Department of Justice.
IRONDALE- The Catholic Church in the United States has lost the Poor Clare nun who changed the face of Catholicism in the United States and around the world. Mother Mary Angelica of the Annunciation, foundress of the Eternal Word Television Network (EWTN), passed away on March 27 after a lengthy struggle with the aftereffects of a stroke. She was 92 years old.

“Mother has always and will always personify EWTN, the network that God asked her to found,” said EWTN Chairman and Chief Executive Officer Michael Warsaw. “Her accomplishments and legacies in evangelization throughout the world are nothing short of miraculous and can only be attributed to divine Providence and her unwavering faithfulness to Our Lord.”

In 1981, Mother Angelica launched Eternal Word Television Network, which today transmits 24-hour-a-day programming to more than 264 million homes in 144 countries. What began with approximately 20 employees has now grown to nearly 400. The religious network broadcasts terrestrial and shortwave radio around the world, operates a religious goods catalog and publishes the National Catholic Register and Catholic News Agency, among other publishing ventures.

“Mother Angelica succeeded at a task the nation’s bishops themselves couldn’t achieve,” said Archbishop Charles Chaput of Philadelphia, who has served on EWTN’s board of governors since 1995. “She founded and grew a network that appealed to everyday Catholics, understood their needs and fed their spirits. She had a lot of help, obviously, but that was part of her genius.”

“In passing to eternal life, Mother Angelica leaves behind a legacy of holiness and commitment to the New Evangelization that should inspire us all,” said Carl Anderson, Supreme Knight of the Knights of Columbus. “I was honored to know and be able to assist Mother Angelica during the early days of EWTN. Over the years, that relationship grew, and today the Knights of Columbus and EWTN partner regularly on important projects.”

“Mother Angelica was fearless because she had God on her side,” Anderson added. “She saw what he needed her to do, and she did it! She transformed the world of Catholic broadcasting and brought the Gospel to far corners of our world. That witness of faith was unmistakable to anyone who met and worked with her, and generations of Catholics have and will continue to be formed by her vision and her ‘Yes’ to God’s will.”

Early Life

Born Rita Rizzo on April 20, 1923, few would have predicted that the girl from a troubled family in Canton, Ohio, would go on to found not only two thriving religious orders, but also the world’s largest religious media network. Her life was one marked by many trials, but also by a profound “Yes” to whatever she felt God was asking of her.

“My parents divorced when I was 6 years old. That’s when hell began,” Mother Angelica said in a Register interview published in 2001. “My mother and I were desperate — moving from place to place, poor, hungry and barely surviving.”

The seeds of Mother’s vocation were in a healing she received when she was a teenager. She suffered from severe stomach pain when she and her mother went to visit Rhoda Wise, a Canton local to whom people had attributed miraculous healings. Wise gave Rita a novena to St. Thérèse of Lisieux. After nine days of prayer, Rita’s pain disappeared: She had been healed.

“That was the day I became aware of God’s love for me and began to thirst for him,” said Mother Angelica. “All I wanted to do after my healing was give myself to Jesus.” And give herself to Jesus, she did.

On Aug. 15, 1944, at the age of 21, Rita entered the Poor Clares of Perpetual Adoration in Cleveland and took the name by which the world would come to know her — Sister Mary Angelica of the Annunciation.

A Promise to God

A life-changing incident then set in motion her abiding trust in Providence.

“In 1946, I was chosen as one of the founding sisters of a new monastery [Sancta Clara] in my hometown of Canton, Ohio,” Mother Angelica said in her 2001 interview with the Register. “One day in the 1950s, my work assignment was to scrub the floors in the monastery.”

“Unlike St. Thérèse, I used an electric scrubbing machine. In an instant, the machine went out of control. I lost my footing on the soapy floor and was thrown against the wall, back first.”

Two years later, the injury had worsened to the point Sister Mary Angelica could barely perform her duties. Hospitalized and awaiting surgery, she was told there was a 50/50 chance she’d never walk again.

“I was panic-stricken and made a bargain with God,” Mother recounted. “I promised if he would allow me to walk again that I would build him a monastery in the South. God kept his end, and through divine Providence, so did I.”

Soon after, she presented her desire to her superior. Confronted with two requests by two different nuns to start separate foundations, the abbess, Mother Veronica, who was Sister Mary Angelica’s novice mistress at the monastery in Cleveland, came up with a novel response.

Mother Veronica mailed two letters on the same day. One, on behalf of Sister Mary of the Cross, was mailed to the bishop of Saint Cloud, Minn.; the other, on behalf of Sister Mary Angelica, was mailed to Mobile-Birmingham, Ala., Archbishop Thomas Toolen. The first nun to receive a positive response from the bishop could proceed with her foundation; the other would abandon her idea. By Providence, Archbishop Toolen responded first, forever wedding Sister Angelica with Alabama.

On Feb. 3, 1961, after various medical problems and potential roadblocks, Rome granted Sister Mary Angelica permission for the Alabama foundation, Our Lady of the Angels Monastery in Irondale, Ala. At the time, the Catholic population of the region was only 2 percent.

Media Apostolate

Mother Angelica was always a charismatic speaker. Her persuasive talks on the faith reached the ears of those in charge of radio and eventually television. In 1969, she began recording spiritual talks on audio for mass distribution. She recorded her first radio program in 1971, 10-minute programs for WBRC, according to her biography, Mother Angelica: The Remarkable Story of a Nun, Her Nerve and a Network of Miracles by Raymond Arroyo, host of EWTN’s The World Over.

Encouraged by her new friend and patron Nashville lawyer Bill Steltemeier, she recorded her first television programs seven years later — half-hour programs called Our Hermitage. It didn’t take long for her to warm to the idea of a faithful Catholic media apostolate.

While utilizing a secular studio to produce programs for a Christian cable television network one day in 1978, Mother Angelica heard that the station owned by the studio planned to air a program she felt was blasphemous.

“When I found out that the station was going to broadcast a blasphemous movie, I confronted the station manager and objected,” said Mother Angelica. “He ignored my complaint, so I told him I would go elsewhere to make my tapes. He told me, ‘You leave this station and you’re off television.’”

“I’ll build my own!” responded Mother Angelica.

“That decision was the catalyst for EWTN,” said Arroyo. “It led to the sisters’ suggestion to turn the garage into a television studio.”

Eternal Word Television Network was launched, fittingly, on the Solemnity of the Assumption of Mary, Aug. 15, 1981. That garage became the first television studio and eventually became the control room — the nerve center — for EWTN’s global television programming.

Spiritual Legacy

Mother’s order, the Poor Clares of Perpetual Adoration, which began in Irondale with five nuns, moved and expanded in 1999 to a monastery at The Shrine of the Most Blessed Sacrament in Hanceville, Ala. The Poor Clares also expanded to new houses in Texas and Arizona.

In November 2015, the Hanceville community was augmented with the arrival of nuns from St. Joseph Adoration Monastery of Charlotte, N.C., which was merged with Our Lady of the Angels, under the leadership of Mother Dolores Marie.

Mother Dolores, who, before becoming a nun, worked for EWTN, described Mother Angelica’s spiritual legacy as a constant striving to respond daily to God’s will.

“When Mother first had her stroke [in 2001], a lot of people said what a shame because she was a voice of the Catholic faith and for the truth,” said Mother Dolores. “But faith tells us that all these 14 years were not wasted at all. Probably her most profound work has gone on in this time, in her silence and suffering. I believe that to be true. Our Lord gave her this time to be truly cloistered in her bed and have that time of deep prayer and intercession and suffering as an offering for the Church and for the world, for our order, for the network, for many things. And ultimately for souls. We won’t know until eternity the value of these past years.”

Mother Marie Andre, one of five nuns who started the Phoenix house and is now the abbess of the Poor Clares’ Our Lady of Solitude Monastery, also recognized Mother’s total commitment to God’s plan.

“She was never fearful of failure, but only fearful of not following God’s will” she added.“Mother described it as a train with several cars. The ‘Yes’ was the engine, with everything else attached to that. If she hadn’t said ‘Yes,’ neither the foundations nor the network would have been founded.”

The Shrine of the Most Blessed Sacrament, like EWTN, continues to draw thousands of visitors annually.

“The first thing you detected with Mother was her spousal love of Jesus. She was always telling people, ‘Jesus loves you,’” said Father Joseph Mary Wolfe, one of the original members of the men’s religious community founded by Mother Angelica, the Franciscan Missionaries of the Eternal Word. Currently, there are 15 friars in the community. The friars are largely involved in EWTN’s apostolate.

Father Joseph summed up Mother’s spiritual legacy as marked by her love of Jesus, centered on the Eucharist, a great trust in divine Providence and a strong family spirit.

Mother Angelica’s remarkable trust in divine Providence is evidenced by founding the network without counting the cost, as well as by how she prepared for her live television shows.

“She never prepared for live shows,” said Father Joseph, who used to work for the network as an engineer. “She would just pray with the crew and then go on television and trust that God would give her the words to say.”

On an EWTN television special for her 90th birthday, Jesuit Father Mitch Pacwa talked about Mother’s authenticity. “To me,” highlighted Father Pacwa, “one of the most important things about Mother Angelica is that what you saw on TV is what you knew off of the stage as well. There was no difference.”

Bishop Robert Baker of the Diocese of Birmingham offered yet another insight into Mother’s rare abilities over the phone on the TV special. “In a special way, I think George Weigel’s book Evangelical Catholicism summarizes what Mother Angelica was about,” Bishop Baker said. “She not only invented that term, many years ago, but put it into practice concretely — working so beautifully off the Scriptures and bringing the truth and the love and the life of the Gospel of Jesus to so many people, not only to our Catholic household of faith, but to many thousands of people who are not Catholic, in that beautiful way she had of touching lives, bringing so many people into the Catholic household of faith.”

Safeguarding the Church

Commentators say that aside from the foundation of the women’s and men’s religious orders, Mother Angelica also played a larger role. Some have asserted that she helped to safeguard the Church in the United States.

“Mother Angelica has been compared to a powerful medieval abbess. But the mass-media instrument she created has extended her influence for the Gospel far beyond that of any medieval abbess, and even beyond that of many of the last century’s most prominent American bishops,” said Mark Brumley, president of Ignatius Press. “Her long-term contribution is hard to assess, of course, but there is no doubt that Mother Angelica has helped root the Church in America more deeply in the Catholic Tradition; and at the same time, she has helped make the Church more innovative in how she communicates that tradition. All Catholics in America should thank God for Mother Angelica.”

“Mother Angelica has two important legacies,” said Arroyo. “To the wider world, she’s the first woman in the history of broadcast to found and lead a network for over 20 years. No one else has ever done that.”

“She was such a great support to Pope John Paul II and his successor,” added Arroyo. “Her active ministry ran parallel to Pope John Paul II’s, and she backed him up at a time when so many people were undermining Church authority, distorting the history and nature of the liturgy and popular devotion and confusing Catholic teaching. She showed that the commonsense approach of Catholics was right. She normalized the truth of the faith at a time when it was up for grabs.”

On Feb. 12, Pope Francis sent his greetings to Mother Angelica from aboard his papal plane to Cuba. “To Mother Angelica with my blessing, and I ask you to pray for me; I need it,” the Holy Father said. “God bless you, Mother Angelica.”

Retirement From Leadership

Mother Angelica retired from her leadership of EWTN in 2000. She suffered a stroke the following Christmas Eve. As a consequence, she spent the last years of her life mostly without the capacity for speech. Arroyo said that didn’t weaken her effectiveness.

“While she was unable to speak at length and sound off on the controversies and confusions of the day, what she did through prayer in her suffering was remarkable,” said Arroyo. “It’s certainly not our efforts that have kept EWTN on the air and allowed it to reach people in amazing ways. I attribute it all to the suffering of that one woman in Hanceville.”

Warsaw praised Mother Angelica as an inspiring model of Christian faith.

“The important thing, as Mother Angelica’s life and the lives so many of the saints have shown us, is to be faithful and to persevere,” he noted. “She once said, ‘You have been created by God and know Jesus for one reason: to witness to faith, hope and love before an unbelieving world.’”

“Mother Angelica’s life has been a life of faith; her prayer life and obedience to God are worthy of our imitation,” Warsaw continued. “Everything she did was an act of faith,” Archbishop Chaput agreed.

“She inspired other gifted people to join her in the work without compromising her own leadership and vision,” he said. “I admired her very much, not just as a talented leader and communicator, but as a friend and great woman religious of generosity, intellect and Catholic faith.”

BIRMINGHAM – U.S. District Judge Abdul K. Kallon on Wednesday sentenced a truck driver from Talladega to 55 years in prison and a lifetime term of supervised release for his aggravated sexual abuse of a child under age 12, announced U.S. Attorney Joyce White Vance and Assistant Attorney General Leslie R. Caldwell of the Justice Department’s Criminal Division.

A federal jury convicted RICK LEE EVANS, 43, on Dec. 11, 2015, for the aggravated sexual abuse of a child.

According to evidence introduced at trial, Evans, a former U.S. Army soldier, and his then-wife, a Department of Defense employee, were living in Germany when they were asked to take temporary custody of a five-year-old child whose parents were deployed to Iraq with the U.S. Army. Trial evidence showed that from May 2007 to December 2008, while the child lived with Evans, he sexually abused the child on multiple occasions.

Assistant U.S. Attorney Jacquelyn Hutzell of the Northern District of Alabama and Trial Attorney Austin M. Berry of the DOJ Criminal Division’s Child Exploitation and Obscenity Section prosecuted the case. U.S. Army Criminal Investigations Division and the FBI’s Birmingham, Alabama, Division investigated the case.

This case was brought as part of Project Safe Childhood, a nationwide initiative to combat the growing epidemic of child sexual exploitation and abuse launched in May 2006 by the Department of Justice. Led by U.S. Attorneys’ Offices and CEOS, Project Safe Childhood marshals federal, state and local resources to better locate, apprehend and prosecute individuals who exploit children via the Internet, as well as to identify and rescue victims.
