Florence attorney gets two years probation

FLORENCE–Luck and Tuscumbia attorney Billy Underwood were on the side of accused Florence attorney Don Tipper today.

Tipper, who was charged with rape and sodomy, was allowed to plead guilty to a single count of sexual misconduct.

According to a plea agreement, Tipper was sentenced to 12 months in jail, suspended for two years

Tipper must also pay a bail bond fee of $750 and $100 to the Alabama Crime Victim’s Compensation Fund.

It is not known if Tipper will be allowed to practice law again. Tipper surrendered his license when he was indicted on the rape and sodomy charges.

Tipper’s attorney Billy Underwood brought up several inconsistencies in the witness testimonies.

The probation will be supervised through Community Corrections.

The case was heard in front of Madison County Circuit Judge Dennis O’Dell.
